By accessing or using the Wai-Y platform and services ("Services") provided by Wai-Y SAS ("Wai-Y," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, you may not use our Services.
Wai-Y provides a platform for monitoring, analyzing, and optimizing how artificial intelligence systems represent organizations across multiple engines, languages, and geographies. Our Services include AI response monitoring, sentiment analysis, content optimization recommendations, and related tools. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.
You must create an account to use our Services. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to provide accurate and complete information during registration and to keep it updated. You must notify us immediately of any unauthorized use of your account. Wai-Y is not liable for losses arising from unauthorized use of your account.
You agree not to: use the Services to disseminate false, misleading, or defamatory information; attempt to manipulate AI systems with fabricated or deceptive content; reverse-engineer, decompile, or disassemble any part of the platform; use the Services to violate any applicable law or regulation; interfere with or disrupt the integrity or performance of the Services; access the Services through automated means (bots, scrapers) without authorization; or resell or redistribute the Services without written consent.
All intellectual property rights in the Services, including software, algorithms, designs, documentation, and trademarks, belong to Wai-Y or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes. You retain ownership of any content you submit to the platform, and you grant Wai-Y a limited license to use such content solely to provide the Services.
To the maximum extent permitted by law, Wai-Y shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services. Our total aggregate liability for any claims related to the Services shall not exceed the amount you paid to Wai-Y in the twelve (12) months preceding the claim. The Services are provided "as is" without warranties of any kind, express or implied.
These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Services shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
